“The Establishment Clause, unlike the Free Exercise Clause, does not depend upon any showing of direct governmental compulsion and is violated by the enactment of laws which establish an official religion whether those laws operate directly to coerce nonobserving individuals or not. This is not to say, of course, that laws officially prescribing a particular form of religious worship do not involve coercion of such individuals. When the power, prestige and financial support of government is placed behind a particular religious belief, the indirect coercive pressure upon religious minorities to conform to the prevailing officially approved religion is plain. But the purposes underlying the Establishment Clause go much further than that. Its first and most immediate purpose rested on the belief that a union of government and religion tends to destroy government and to degrade religion. The history of governmentally established religion, both in England and in this country, showed that whenever government had allied itself with one particular form of religion, the inevitable result had been that it had incurred the hatred, disrespect and even contempt of those who held contrary beliefs. That same history showed that many people had lost their respect for any religion that had relied upon the support of government to spread its faith. The Establishment Clause thus stands as an expression of principle on the part of the Founders of our Constitution that religion is too personal, too sacred, too holy, to permit its "unhallowed perversion" by a civil magistrate. Another purpose of the Establishment Clause rested upon an awareness of the historical fact that governmentally established religions and religious persecutions go hand in hand. The Founders knew that only a few years after the Book of Common Prayer became the only accepted form of religious services in the established Church of England, an Act of Uniformity was passed to compel all Englishmen to attend those services and to make it a criminal offense to conduct or attend religious gatherings of any other kind-- a law which was consistently flouted by dissenting religious groups in England and which contributed to widespread persecutions of people like John Bunyan who persisted in holding "unlawful [religious] meetings... to the great disturbance and distraction of the good subjects of this kingdom...."”

The general principle that the constitutional guaranty of the liberty of the press gives immunity from previous restraints has been approved in many decisions under the provisions of state constitutions. The importance of this immunity has not lessened. While reckless assaults upon public men, and efforts to bring obloquy upon those who are endeavoring faithfully to discharge official duties, exert a baleful influence and deserve the severest condemnation in public opinion, it cannot be said that this abuse is greater, and it is believed to be less, than that which characterized the period in which our institutions took shape. Meanwhile, the administration of government has become more complex, the opportunities for malfeasance and corruption have multiplied, crime has grown to most serious proportions, and the danger of its protection by unfaithful officials and of the impairment of the fundamental security of life and property by criminal alliances and official neglect, emphasizes the primary need of a vigilant and courageous press, especially in great cities. The fact that the liberty of the press may be abused by miscreant purveyors of scandal does not make any the less necessary the immunity of the press from previous restraint in dealing with official misconduct. Subsequent punishment for such abuses as may exist is the appropriate remedy consistent with constitutional privilege.”

“Graduation was nice. General Clark liked it. The Board of Visitors liked it. Moms and Dads liked it. And the Cadets hated it, for without a doubt it ranked as the most boring event of the year. Thus it was in 1964 that the Clarey twins pulled the graduation classic. When Colonel Hoy called the name of the first twin, instead of walking directly to General Clark to receive his diploma, he headed for the line of visiting dignitaries, generals, and members of the Board of Visitors who sat in a solemn semi-circle around the stage. He shook hands with the first startled general, then proceeded to shake hands and exchange pleasantries with every one on the stage. He did this so quickly that it took several moments for the whole act to catch on. When it finally did, the Corps went wild. General Clark, looking like he had just learned the Allies had surrendered to Germany, stood dumbfounded with Clarey number one's diploma hanging loosely from his hand; then Clarey number two started down the line, repeating the virtuoso performance of Clarey number one, as the Corps whooped and shouted their approval. The first Clarey grabbed his diploma from Clark and pumped his hand vigorously up and down. Meanwhile, his brother was breezing through the hand-shaking exercise. As both of them left the stage, they raised their diplomas above their heads and shook them like war tomahawks at the wildly applauding audience. No graduation is remembered so well.”

All this may be briefly answered. There was no representation of the Jewish patriarchs or saints either in the tabernacle or in the temple of Solomon, as is the case with the Christian saints in the Roman Catholic and Græco-Russian Churches; and the brazen serpent, to which the author alludes, was broken into pieces by order of King Hezekiah as soon as the Israelites began to worship it.”

“Suspecting that we would be accused of apologetics for the Khmer Rouge, Chomsky and I went to some pains to point out Khmer Rouge crimes and to stress that our purpose was to emphasize the discrepancy between available facts and media claims and to lay bare what we saw to be a propaganda campaign of selective indignation and benevolence. This effort was futile. With such a powerful propaganda bandwagon underway, from the very beginning the mass media were closed to oppositional voices on the issue, and any scepticism, even identification of outright lies, was treated with hostility and tabbed apologetics for the Khmer Rouge. Our crime was the very act of criticizing the workings of the propaganda system and its relation to US power and policy, instead of focusing attention on approved villainy, which could be assailed violently and ignorantly, without penalty. The issue was framed as a simple one: those for and against Pol Pot. […] I would estimate with some confidence that over 90 percent of the journalists who mentioned Chomsky's name in connection with Cambodia never looked at his original writings on the subject, but merely regurgitated a quickly adopted line. The critics who helped formulate the line also could hardly be bothered looking at the actual writings; the method was almost invariably the use of a few selected quotations taken out of context and embedded in a mass of sarcastic and violent denunciation.”

“I was perversely delighted to see the Catholic Church and the Vatican go after nuns because I think they made a major error. People are quite clear in viewing nuns as the servants and the teachers and the supporters of the poor. You contrast that with the fact that the Vatican did virtually nothing about long-known pedophiles, and it’s just too much.
Their stance on abortion is also quite dishonest historically, because as the Jesuits (who always seem to be more honest historians of the Catholic Church) point out, the Church approved of and even regulated abortion well into the mid-1800s. The whole question of ensoulment was determined by the date of baptism. But after the Napoleonic Wars there weren’t enough soldiers anymore and the French were quite sophisticated about contraception. So Napoleon III prevailed on Pope Pius IX to declare abortion a mortal sin, in return for which Pope Pius IX got all the teaching positions in the French schools and support for the doctrine of papal infallibility. … My favorite line belongs to an old Irish woman taxi driver in Boston. Flo Kennedy and I were in the backseat talking about Flo’s book, Abortion Rap (1971), and the driver turned around and said, “Honey, if men could get pregnant, abortion would be a sacrament.” I wish I’d gotten her name so we could attribute it to her.”
