“The messages of the prophets are essentially indictments of Israel for breach of covenant. They preserved some memory of the old traditions, but were not so naive as to think that the literal demands of the old law would be adequate in their own times. There is no condemnation of the stratification of society as such, rather a condemnation of the injustice and extortion which was done by the powerful. To take a specific example, the old law knew as security for a loan only the pledge (Exod. 22:26). In a simple economy, loans were evidently of an amount which would usually be adequately secured by giving to the creditor some property to hold until the loan was repaid. In case of default, the debtor's property simply reverted to the creditor. No other form of security is presupposed in the Covenant Code, and it is specifically forbidden that an Israelite be a "creditor" to one of his fellows. Already in the reign of Saul the situation had changed, Those who gathered about David as outlaws included those who had "creditors" (I Sam. 22:2), and who therefore had to flee. Under the old pledge system of security there would be no possible occasion for flight from the community in case of default. A totally different legal doctrine had come into practice whereby the person of the debtor was security for a loan. Upon default the creditor could seize him (or his family) as a slave, possibly without any legal action at all. The only alternative to slavery would have been flight. This doctrine is identical to that of Babylonian law, and no doubt of the Canaanites as well. It is in the law of the monarchy that Canaanite influence is doubtless to be posited, but it is a legal tradition in total contradiction to the customs and morality of early Israel. Amos protested violently against the way the legal doctrine was practiced, as did most of the prophets (Am. 2:6; Hos. 12:8-9; Mic. 2:1-2). The later lawcodes illustrate beautifully the way in which the early traditions, and the needs of business were brought into harmony. The older pledge system was simply inadequate for a commercial economy; and if the person of the debtor was to be protected, so also must the rights of the creditor to some security for his loan to be guaranteed. Therefore, Deuteronomy and the Holiness Code (Lv. 17-26) accept the doctrine of bodily liability, but place restrictions upon the powers of the creditor over the defaulting debtor. In the Holiness Code he is not to be treated as a slave, nor given the legal status of a slave, but rather to be as a hired laborer.”

I suppose a lot of this could simply be the bad taste his earlier work left for me. All that tearing down and “deconstructionism.””

“Our Italian ally has been a source of embarrassment to us everywhere. It was this alliance, for instance, which prevented us from pursuing a revolutionary policy in North Africa. In the nature of things, this territory was becoming an Italian preserve and it was as such that the Duce laid claim to it. Had we been on our own, we could have emancipated the Moslem countries dominated by France; and that would have had enormous repercussions in the Near East, dominated by Britain, and in Egypt. But with our fortunes linked to those of the Italians, the pursuit of such a policy was not possible. All Islam vibrated at the news of our victories. The Egyptians, the Irakis and the whole of the Near East were all ready to rise in revolt. Just think what we could have done to help them, even to incite them, as would have been both our duty and in our own interest! But the presence of the Italians at our side paralysed us; it created a feeling of malaise among our Islamic friends, who inevitably saw in us accomplices, willing or unwilling, of their oppressors. For the Italians in these parts of the world are more bitterly hated, of course, than either the British or the French. The memories of the barbarous, reprisals taken against the Senussi are still vivid. Then again the ridiculous pretensions of the Duce to be regarded as The Sword of Islam evokes the same sneering chuckle now as it did before the war. This title, which is fitting for Mahomed and a great conqueror like Omar, Mussolini caused to be conferred on himself by a few wretched brutes whom he had either bribed or terrorized into doing so. We had a great chance of pursuing a splendid policy with regard to Islam. But we missed the bus, as we missed it on several other occasions, thanks to our loyalty to the Italian alliance! In this theatre of operations, then, the Italians prevented us from playing our best card, the emancipation of the French subjects and the raising of the standard of revolt in the countries oppressed by the British. Such a policy would have aroused the enthusiasm of the whole of Islam. It is a characteristic of the Moslem world, from the shores of the Atlantic to those of the Pacific, that what affects one, for good or for evil, affects all.”

“All sultans were keen on making slaves, but Muhammad Tughlaq became notorious for enslaving people. He appears to have outstripped even Alauddin Khalji and his reputation in this regard spread far and wide. Shihabuddin Ahmad Abbas writes about him thus:
“The Sultan never ceases to show the greatest zeal in making war upon infidels… Everyday thousands of slaves are sold at a very low price, so great is the number of prisoners”. Muhammad Tughlaq did not only enslave people during campaigns, he was also very fond of purchasing and collecting foreign and Indian slaves. According to Ibn Battuta one of the reasons of estrangement between Muhammad Tughlaq and his father Ghiyasuddin Tughlaq, when Muhammad was still a prince, was his extravagance in purchasing slaves. Even as Sultan, he made extensive conquests. He subjugated the country as far as Dwarsamudra, Malabar, Kampil, Warangal, Lakhnauti, Satgaon, Sonargaon, Nagarkot and Sambhal to give only few prominent place-names. There were sixteen major rebellions in his reign which were ruthlessly suppressed. In all these conquests and rebellions, slaves were taken with great gusto. For example, in the year 1342 Halajun rose in rebellion in Lahore. He was aided by the Khokhar chief Kulchand. They were defeated. “About three hundred women of the rebels were taken captive, and sent to the fort of Gwalior where they were seen by Ibn Battutah.” Such was their influx that Ibn Battutah writes: “At (one) time there arrived in Delhi some female infidel captives, ten of whom the Vazir sent to me. I gave one of them to the man who had brought them to me, but he was not satisfied. My companion took three young girls, and I do not know what happened to the rest.” Iltutmish, Muhammad Tughlaq and Firoz Tughlaq sent gifts of slaves to Khalifas outside India….. Ibn Battutah’s eye-witness account of the Sultan’s gifting captured slave girls to nobles or arranging their marriages with Muslims on a large scale on the occasion of the two Ids, corroborates the statement of Abbas. Ibn Battutah writes that during the celebrations in connection with the two Ids in the court of Muhammad bin Tughlaq, daughters of Hindu Rajas and those of commoners, captured during the course of the year were distributed among nobles, officers and important foreign slaves. “On the fourth day men slaves are married and on the fifth slave-girls. On the sixth day men and women slaves are married off.” This was all in accordance with the Islamic law. According to it, slaves cannot many on their own without the consent of their proprietors. The marriage of an infidel couple is not dissolved by their jointly embracing the faith. In the present case the slaves were probably already converted and their marriages performed with the initiative and permission the Sultan himself were valid. Thousands of non-Muslim women were captured by the Muslims in the yearly campaigns of Firoz Tughlaq, and under him the id celebrations were held on lines similar to those of his predecessor. In short, under the Tughlaqs the inflow of women captives never ceased.”
