The mistake here is the error of the excluded middle. There are extremes in this debate, but the extremes are not all that there is. There are those who believe in maximal copyright — "All Rights Reserved" — and those who reject copyright — "No Rights Reserved." The "All Rights Reserved" sorts believe that you should ask permission before you "use" a copyrighted work in any way. The "No Rights Reserved" sorts believe you should be able to do with content as you wish, regardless of whether you have permission or not.... What's needed is a way to say something in the middle — neither "all rights reserved" nor "no rights reserved" but "some rights reserved" — and thus a way to respect copyrights but enable creators to free content as they see fit. In other words, we need a way to restore a set of freedoms that we could just take for granted before.

Context: I must make the important distinction between the rebel and the revolutionary. One is in ineradicable opposition to the other. The revolutionary seeks an external political change, "the overthrow or renunciation of one government or ruler and the substitution of another." The origin of the term is the word revolve, literally meaning a turnover, as the revolution of a wheel. When the conditions under a given government are insufferable some groups may seek to break down that government in the conviction that any new form cannot but be better. Many revolutions, however, simply substitute one kind of government for another, the second no better than the first — which leaves the individual citizen, who has had to endure the inevitable anarchy between the two, worse off than before. Revolution may do more harm than good.
The rebel, on the other hand, is "one who opposes authority or restraint: one who breaks with established custom or tradition." … He seeks above all an internal change, a change in the attitudes, emotions, and outlook of the people to whom he is devoted. He often seems to be temperamentally unable to accept success and the ease it brings; he kicks against the pricks, and when one frontier is conquered, he soon becomes ill-at-ease and pushes on to the new frontier. He is drawn to the unquiet minds and spirits, for he shares their everlasting inability to accept stultifying control. He may, as Socrates did, refer to himself as the gadfly for the state — the one who keeps the state from settling down into a complacency, which is the first step toward decadance. The reason I gave for this was so flimsy, while the inference was so nearly the gist of Pragmaticism, that I must confess the argument of that essay might with some justice be said to beg the question. The first part of the essay, however, is occupied with showing that, if Truth consists in satisfaction, it cannot be any actual satisfaction, but must be the satisfaction which would ultimately be found if the inquiry were pushed to its ultimate and indefeasible issue. This, I beg to point out, is a very different position from that of Mr Schiller and the pragmatists of to-day. Context: Science traditionally takes the reductionist approach, saying that the collective properties of molecules, or the fundamental units of whatever system you're talking about, are enough to account for all of the system's activity. But this standard approach leaves out one very important additional factor, and that's the spacing and timing of activity — its pattern or form. The components of any system are linked up in different ways, and these possible relationships, especially at the higher levels, are not completely covered by the physical laws for the elementary interactions between atoms and molecules. At some point, the higher properties of the whole begin to take over and govern the fate of its constituents.
A simple way to illustrate this idea is to imagine a molecule in an airplane flying from L. A. to New York. The molecule may be jostled somewhat or held in position by its neighbors, but these lower-level actions are trivial compared to its movement as the plane flies across the continent. If you plot the movement of the molecule through time and space, those features governed by the higher properties of the plane as a whole make those controlled at the level of the molecule insignificant by comparison. Like Stallman's arguments for free software, an argument for free culture stumbles on a confusion that is hard to avoid, and even harder to understand. So they call up Matt Groening, who was a friend of the documentary filmmaker, and say, you know, Is this going to be a problem? It's only a couple seconds. Matt says, No, no, no, it's not going to be a problem, call so and so. So they called so and so, and so and so said call so and so.
Eventually, the so and so turns out to be the lawyers, so when they got to the lawyers, they said, Is this going to be a problem? It's a documentary film. It's about education. It's a couple seconds. The so and so said 25,000 bucks. 25,000 bucks?! It's a couple seconds! What do you mean 25,000 bucks? The so and so said, I don't give a goddamn what it is for. $25,000 bucks or change your movie. Now you look at this and you say this is insane. It's insane. And if it is only Hollywood that has to deal with this, OK, that's fine. Let them be insane. Context: Churches also have their problems with a Jesus whose only economics are jokes. A savior undermines the foundations of any social doctrine of the Church. But that is what He does, whenever He is faced with money matters. According to Mark 12:13 there was a group of Herodians who wanted to catch Him in His own words. They ask "Must we pay tribute to Caesar?" You know His answer: "Give me a coin – tell me whose profile is on it!." Of course they answer "Caesar's."

A Roman coin was no impersonal silver dollar; there was none of that "trust in God" or adornment with a presidential portrait. A denarius was a piece of precious metal branded, as it were, like a heifer, with the sign of the personal owner. Not the Treasury, but Caesar coins and owns the currency. Only if this characteristic of Roman currency is understood, one grasps the analogy between the answer to the devil who tempted Him with power and to the Herodians who tempt Him with money. His response is clear: abandon all that which has been branded by Caesar; but then, enjoy the knowledge that everything, everything else is God's, and therefore is to be used by you.
The message is so simple: Jesus jokes about Caesar. He shrugs off his control. And not only at that one instance… Remember the occasion at the Lake of Capharnaum, when Peter is asked to pay a twopenny tax. Jesus sends him to throw a line into the lake and pick the coin he needs from the mouth of the first fish that bites. Oriental stories up to the time of Thousand Nights and One Night are full of beggars who catch the fish that has swallowed a piece of gold. His gesture is that of a clown; it shows that this miracle is not meant to prove him omnipotent but indifferent to matters of money. Who wants power submits to the Devil and who wants denarri submits to the Caesar.

Context: Here's a simple copyright lesson: Law regulates copies. What's that mean? Well, before the Internet, think of this as a world of all possible uses of a copyrighted work. Most of them are unregulated. Talking about fair use, this is not fair use; this is unregulated use. To read is not a fair use; it's an unregulated use. To give it to someone is not a fair use; it's unregulated. To sell it, to sleep on top of it, to do any of these things with this text is unregulated. Now, in the center of this unregulated use, there is a small bit of stuff regulated by the copyright law; for example, publishing the book — that's regulated. And then within this small range of things regulated by copyright law, there's this tiny band before the Internet of stuff we call fair use: Uses that otherwise would be regulated but that the law says you can engage in without the permission of anybody else. For example, quoting a text in another text — that's a copy, but it's a still fair use. That means the world was divided into three camps, not two: Unregulated uses, regulated uses that were fair use, and the quintessential copyright world. Three categories.
Enter the Internet. Every act is a copy, which means all of these unregulated uses disappear. Presumptively, everything you do on your machine on the network is a regulated use. And now it forces us into this tiny little category of arguing about, "What about the fair uses? What about the fair uses?" I will say the word: To hell with the fair uses. What about the unregulated uses we had of culture before this massive expansion of control?

Soul therefore, when irrational, is the life of sense and imagination; when rational, it is the life which controls sense and imagination and uses reason. The irrational soul depends on the affections of the body; it feels desire and anger irrationally. The rational soul both, with the help of reason, despises the body, and, fighting against the irrational soul, produces either virtue or vice, according as it is victorious or defeated.
