On the Aesthetic Education of Man (1794)
Context: The voice of our age seems by no means favorable to art, at all events to that kind of art to which my inquiry is directed. The course of events has given a direction to the genius of the time that threatens to remove it continually further from the ideal of art. For art has to leave reality, it has to raise itself bodily above necessity and neediness; for art is the daughter of freedom, and it requires its prescriptions and rules to be furnished by the necessity of spirits and not by that of matter. But in our day it is necessity, neediness, that prevails, and bends a degraded humanity under its iron yoke. Utility is the great idol of the time, to which all powers do homage and all subjects are subservient. In this great balance of utility, the spiritual service of art has no weight, and, deprived of all encouragement, it vanishes from the noisy Vanity Fair of our time. The very spirit of philosophical inquiry itself robs the imagination of one promise after another, and the frontiers of art are narrowed, in proportion as the limits of science are enlarged.

Context: The theologians who took up the work which the first reformers had laid down soon came to consider intolerance as a main evidence of spiritual life: erelong they were using all their powers in crushing every germ of new thought. Their theory was simply that the world had now reached its climax; that the religion of Luther was the final word of God to man; that everything depended upon keeping it absolutely pure; that men might comment upon it in hundreds of pulpits and lecture rooms and in thousands of volumes;—but change it in the slightest particle—never. And in order that it might never be changed it was petrified into rituals and creeds and catechisms and statements, and, above all, in 1579, into the "Formula of Concord," which, as more than one thoughtful man has since declared, turned out to be a "formula of discord."

McCulloch v. Maryland (1819)
Context: The subject is the execution of those great powers on which the welfare of a Nation essentially depends. It must have been the intention of those who gave these powers, to insure, as far as human prudence could insure, their beneficial execution. This could not be done by confiding the choice of means to such narrow limits as not to leave it in the power of Congress to adopt any which might be appropriate, and which were conducive to the end. This provision is made in a constitution intended to endure for ages to come, and, consequently, to be adapted to the various crises of human affairs.

The reality of this world is necessity. The part of man which is in this world is the part which is in bondage to necessity and subject to the misery of need.
The one possibility of indirect expression of respect for the human being is offered by men's needs, the needs of the soul and of the body, in this world.
